PREAMBLE
--------------------------------------------------------------------------------

This is an open license, not an open source license. The term "open" in this
license refers only to the permissions granted herein and does not imply or
invoke the open source definition.

This license is a non-commercial license that permits the work to be shared,
used, modified, and distributed free of charge for non-commercial purposes
only.

"Non-commercial" means any use primarily intended for or directed toward
commercial advantage or monetary compensation is prohibited without explicit
written authorization from the original author.

"Free-sharing" means the work may be freely accessed, copied, modified, and
distributed by any person, provided that all such activities remain within the
scope of non-commercial purposes and comply with the terms of this license.

--------------------------------------------------------------------------------

This license is a general-purpose non-commercial license applicable to any type
of work, including but not limited to source code packages, video works, audio
works, documents, images, datasets, model weights, and other copyrightable
works.

The license may be cited in any form, provided that the cited version is an
unmodified version of NCL. You may either self-host the unmodified full text or
link to the official NCL website at http://www.0988890.xyz. Anyone who receives
the work must be able to find and read the unmodified license text.

The full text of this license is the legally operative "legal code." Any
human-readable summaries, explanations, or descriptions of this license
elsewhere, including on the official website, are provided for informational
purposes only and are not legally binding. In case of any discrepancy between
the legal code and any summary, the legal code prevails.

All language versions of this license are equally authoritative. In case of any
discrepancy between language versions, the English version shall prevail.

1. GRANT OF RIGHTS

You are granted the rights to view, copy, modify, distribute, and privately use
the work, provided that all use is for non-commercial purposes only.

Distribution is permitted only free of charge. You may not charge any fee for
the work itself, except for the actual and verifiable cost of physical
distribution media.

2. DEFINITION OF COMMERCIAL USE

"Commercial Use" means any use primarily intended for or directed toward
commercial advantage or monetary compensation. This includes, but is not
limited to:

- Selling, licensing, or sublicensing the work for a fee
- Incorporating the work into a commercial product or service
- Using the work to generate revenue directly or indirectly
- Using the work to train or develop commercial AI, machine learning models,
  or large language models
- Using the work in any automated service, SaaS platform, or cloud offering
  that generates revenue
- Using the work internally within a for-profit organization to support
  revenue-generating activities
- Charging for access to the work, including paywalled documentation, paid
support, or training services centered on the work
- Monetizing the work through advertising or sponsorships
- Bundling the work with paid products or services
- Data monetization derived from the work

The following are NOT considered Commercial Use:

- Personal learning and education
- Academic research at non-profit institutions
- Open source contributions without monetary compensation
- Content creation (teaching, streaming, educational materials) even if it
  generates incidental revenue
- Charging only for the actual, verifiable cost of physical distribution media

If a use has both commercial and non-commercial purposes, it shall be deemed
Commercial Use if the primary purpose at the time of use is commercial.

Whether a particular use is commercial depends on the specific circumstances
and the intent of the user. If you are uncertain about whether your intended
use is permitted under this license, you should contact the original author
for clarification before proceeding.

3. CONTACT INFORMATION REQUIREMENT

The original author MUST provide valid contact information.

The contact information must be placed in the place where the work is published
or within the work itself, in a clearly visible location. This may be a file
named CONTACT.md, a section in the video or its description, a metadata field,
a publication page, or any other location that a recipient of the work can
reasonably find.

Contributors may add their own contact information, provided that the original
author contact information is not removed or altered and the contributor
information is clearly separated and distinguishable.

If the original author does NOT provide contact information, the license
remains valid but is automatically classified as "Strictly Non-Commercial"
status, meaning only the original author retains commercial rights, no third
party may apply for commercial authorization, and the work is effectively
treated as "No Commercial Use for Anyone Except the Original Author".

If the original author later provides contact information, the work
automatically returns to the standard NCL status as described in this license.

4. ORIGINAL AUTHOR RIGHTS

The original author retains full and exclusive commercial rights to the work.
The original author may use, license, or monetize the work for commercial
purposes without restriction.

Any third party seeking to use the work for commercial purposes must obtain
explicit written authorization from the original author. This requirement
applies to all forks, derivatives, and subsequent versions of the work,
regardless of who created them.

5. FORM OF COMMERCIAL AUTHORIZATION

"Explicit written authorization" must be in a documented, verifiable written
form. Acceptable forms include signed documents, emails, or text messages from
instant messaging applications. Voice calls, verbal agreements, implied
consent, or ambiguous expressions do not constitute valid authorization.

If the work is created by multiple authors, all authors jointly retain the
exclusive commercial rights. No single author may grant commercial
authorization without the explicit written consent of all other authors.

In the event of copyright transfer, the transferee assumes all rights and
obligations of the transferor under this license.

6. ATTRIBUTION REQUIREMENT

Modified versions must retain the original author's attribution solely within
the source code. This attribution must remain intact and clearly visible in all
source code files. When the work is distributed to the public or publicly
displayed, the distributor must clearly indicate that it is based on work
originally created by the original author and licensed under NCL.

You may not use the name, trademarks, or branding of the original author to
endorse or promote your derivative work without explicit permission.

7. LICENSE-ADD

The licensee may add their own additional terms, placed separately in a
LICENSE-ADD file, that do not conflict with the core terms. These additional
terms may include warranty disclaimers, limitation of liability, additional
permissions, additional restrictions, or choice of law and jurisdiction
clauses.

If any term in the LICENSE-ADD conflicts with the core terms of this license,
the core terms shall prevail. The LICENSE-ADD file must not modify the LICENSE
file itself.

8. ANTI-CIRCUMVENTION AND TECHNICAL RESTRICTIONS

Any attempt to circumvent the terms of this license through technical means is
strictly prohibited. This includes code obfuscation, variable or function
renaming, extracting and reassembling portions of the work, or any other
modification whose primary purpose is to conceal the origin of the work or
evade compliance with this license. Translating the work into another language
or format is prohibited only when such translation is primarily intended to
circumvent the terms of this license.

You may not distribute, publicly display, or otherwise make available the work
with any technological measures that alter, restrict, or prevent the exercise
of the rights granted under this license. Such acts constitute a material
breach.

9. COPYLEFT REQUIREMENT

Any modified version of the work must be released under the same license (NCL)
or a license that is fully compatible with NCL's non-commercial terms. Licenses
that permit commercial use, including but not limited to GPL, MIT, Apache,
BSD, and MPL, are NOT compatible with NCL.

Modified works may only be distributed under NCL or another license that
contains the same non-commercial restrictions. If the modifier adds their own
new content, those additions may be released under a different license of the
modifier's choice, provided that the original NCL-licensed portion remains
under NCL, the NCL license text itself is not modified, and the derivative work
as a whole clearly indicates which parts are governed by NCL and which parts
are governed by other licenses.

10. LICENSE TERMINATION AND REINSTATEMENT

Any violation results in automatic termination of this license, effective
immediately. Upon termination, the licensee must cease all use, distribution,
and modification of the work.

However, if the licensee ceases all violation and comes into full compliance
with this license within 30 days after receiving written notice of the
violation from the original author, the license shall be automatically
reinstated. This reinstatement does not apply if the original author has
previously notified the licensee of a violation of this license and the
licensee has failed to cure within the applicable period.

The provisions regarding disclaimer of warranties, limitation of liability,
and indemnification shall survive termination.

11. ENFORCEMENT

License enforcement and legal remedies shall be undertaken solely by the
original author. The original author must independently handle any breach of
contract, including but not limited to pursuing legal action, retaining legal
counsel, and bearing all associated costs. The license drafter and the NCL Team
assume no responsibility for enforcement, legal action, or any disputes arising
from the use of this work.

12. DISCLAIMER OF WARRANTIES

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE WORK IS PROVIDED "AS
IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT
LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE,
AND NON-INFRINGEMENT. IN NO EVENT SHALL THE COPYRIGHT HOLDERS OR CONTRIBUTORS
BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR
CONSEQUENTIAL DAMAGES ARISING IN ANY WAY OUT OF THE USE OF THIS WORK, EVEN IF
ADVISED OF THE POSSIBILITY OF SUCH DAMAGE.

Nothing in this disclaimer shall exclude or limit any warranty or liability
that cannot be excluded or limited under applicable law, including but not
limited to consumer protection laws in jurisdictions where such laws apply.

13. GOVERNING LAW

This license does not prescribe any specific governing law. If the original
author does not designate a governing law through LICENSE-ADD, this license
shall be interpreted in accordance with the laws of the original author's
principal place of business. If such place cannot be determined, the English
version of this license shall be used for interpretive purposes.

14. SEVERABILITY

If any provision of this license is held to be invalid or unenforceable by a
court of competent jurisdiction, that provision shall be enforced to the
maximum extent permitted by law, and the remaining provisions shall remain in
full force and effect.

15. NO WAIVER

The failure of the original author to exercise or enforce any right or
provision of this license shall not constitute a waiver of such right or
provision.

16. ENTIRE AGREEMENT

This license, together with any LICENSE-ADD file, constitutes the entire
agreement between the parties with respect to the work and supersedes all prior
understandings, whether written or oral.

17. UPDATE NOTICE

This license may be revised from time to time without prior notice. After a new
version is released, the old version remains valid. The terms of the new
license apply only to projects adopting the new version and do not retroactively
apply to projects using the old version.

Any published version of this license must include the version number in its
title. The title, including the version number, is part of the legal code and
must not be altered.

Authors are strongly advised to add their own additional terms to avoid gaps in
protection, or to promptly update to the latest license version to mitigate
enforcement risks.
